Placing construction products on the European Union market

The European market is quite attractive for Ukrainian manufacturers of construction products. However, for its admission and free movement on the EU market, it is necessary to undergo certification and confirm compliance with EU Regulation 305/2011 on construction products.

About EU Regulation 305/2011

The European Union Regulation (EU) No 305/2011 on construction products entered into force on 1 July 2011. This EU regulation replaced Directive 89/106/EEC.

The Regulation establishes harmonised requirements for the manufacture and marketing of construction products. One of the main requirements is to ensure that all market participants ensure the safety of construction materials for the life and health of humans, animals, property and the environment.

To ensure quality and safety, all construction products placed on the European market must comply with the requirements of Regulation 305/2011.

Construction products that comply with European standards and Regulation 305/2011 are marked with the CE mark. By affixing or having affixed the CE mark, the manufacturer confirms that he accepts responsibility for the conformity of the construction product with the requirements of Regulation 305/2011.

Scope

The regulation applies to all construction products and materials produced or placed on the market for use in construction.

Requirements of EU Regulation 305/2011

The Regulation establishes the conditions for placing products on the construction products market, as well as the requirements for the declaration of performance of the products and the use of the CE marking on the products.

In order to obtain the right to affix the CE marking to construction products covered by harmonised standards, the manufacturer must draw up a declaration of performance (hereinafter referred to as the Declaration).

Depending on the type of product, the Declaration can be drawn up either on the basis of its own evidence or on the basis of reports from an accredited laboratory.

The declaration must contain the following information:

  • product type;
  • the name of the manufacturer and its address;
  • system or systems for assessing the quality characteristics of construction products;
  • number and date of issue of the harmonised standard;
  • list of characteristics for the declared product;
  • description of existing characteristics.

The regulation provides for five systems of conformity assessment depending on the type of construction product:

  • System 1 – certification of the factory production control (FPC) system and conducting control tests;
  • System 1+ – certification of the production control system (FPC) and determination of product type for control tests;
  • System 2+ – certification of the factory production control (FPC) system with subsequent periodic monitoring;
  • System 3 – initial testing by a notified laboratory;
  • System 4 – Control is carried out by the manufacturer itself, without the involvement of conformity assessment bodies.

Traceability and FPC

Traceability of products during the production process is one of the main requirements of the building regulations. For these purposes, a system ensuring traceability requirements must be implemented and operated at the enterprise producing construction products.

Система заводського виробничого контролю (FPC - Factory Production Control) should cover everything related to product conformity, including personnel, equipment, design process, inspection procedures to verify and record compliance with component specifications, test plans, evaluation of production processes, procedures for handling nonconformities. The FPC system should cover all significant processes, production lines, and departments.

Basic requirements for building structures

Building structures and their individual parts must be suitable for their intended use and meet the following basic requirements:

  • mechanical resistance and durability;
  • stability;
  • fire safety;
  • compliance with hygiene requirements;
  • safety in use;
  • safety in use;
  • noise protection;
  • ecological use of natural resources.

Causing CE marking

The CE mark indicates that the product complies with the requirements of European harmonized legislation stated in the declaration and that a conformity assessment procedure has been carried out.

The manufacturer, distributor or his authorized (authorized) representative affixes the CE marking on the product label, packaging, accompanying documentation, in accordance with the rules for affixing the CE marking.

CE marking must be affixed to construction products for which the manufacturer has made a declaration in accordance with Articles 4 and 6 of Regulation (EU) No 305/2011. In addition to the CE marking, additional information on certain performance characteristics of the product shall be affixed to construction products. The requirements for the information to be affixed are specified in the harmonised standards and depend on each specific finished product.

Obligations of economic operators

Manufacturers are fully responsible for the production of construction products that comply with the requirements of European legislation and EU Regulation 305/2011. The manufacturer is obliged to draw up a declaration of performance, affix the CE marking and draw up the necessary technical documentation for the products and ensure that the products manufactured comply with the declared characteristics.

Manufacturers must keep the technical documentation and the declaration of quality characteristics for 10 years after the construction product has been placed on the market.

Authorized representatives. If the manufacturer is not a resident of one of the EU countries, he should entrust the signing of the declaration to an authorized person resident in the EU. For this purpose, a corresponding agreement must be signed. The authorized representative may perform at least the following functions:

  • sign and keep the declaration;
  • keep a technical file and make it available, upon reasoned request from a competent national authority, to provide that authority with all the information and documentation necessary to demonstrate the conformity of the construction product with the requirements of the declaration and compliance with other requirements of the building regulations;
  • cooperate with competent national authorities.

Importers and distributors, before placing products on the EU market, are obliged to verify that the product has been correctly assessed by the manufacturer, that it complies with the declared quality characteristics, is accompanied by the necessary documentation and that the CE marking has been correctly affixed. They are fully responsible for the storage, transportation and availability of the products on the market.
