The Technical Regulation is developed on the basis of Directive 2014/53/EU of the European Parliament and of the Council of 16 April 2014 on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment. The Technical Regulation establishes requirements for radio equipment made available on the market and put into service in Ukraine, regardless of the form of supply.
According to the definition in this Technical Regulation:
- radio equipment- an electrical or electronic product that is intended (or equipped with an additional device) to emit and/or receive radio waves for the purpose of radio communication and/or radio detection.
- radio waves - These are electromagnetic waves with frequencies below 3000 GHz that propagate in space without an artificial guiding medium.
This Technical Regulation does not apply to:
- radio equipment used by radio amateurs, if such equipment is not available on the market.
- ship equipment subject to the Technical Regulations for Marine Equipment;
- aviation equipment, in accordance with the Air Code of Ukraine;
- radio equipment used exclusively at scientific and research facilities.
- radio equipment used exclusively for the purpose of ensuring public safety, defense and security of the state, protection of the state border, criminal procedural activities, and the functioning of the unified civil-military system of air traffic management of Ukraine.
Radio equipment is put into operation and used on the territory of Ukraine only if it meets the requirements of the Technical Regulations, and subject to proper installation, maintenance and use for its intended purpose.
Radio equipment that has a low level of compliance with the essential requirements of the Technical Regulations must be entered into the register of radio electronic means and radiating devices of the NCCIR (National Commission for State Regulation in the Sphere of Communications and Information) before being put into circulation. The NCCIR provides each registered type of radio equipment with a registration number, which manufacturers must affix to the radio equipment being put into circulation.
In order to confirm compliance with the essential requirements of the Technical Regulations, it is necessary to conduct a conformity assessment of the radio equipment. The conformity assessment must take into account all the prescribed operating conditions.
Compliance of radio equipment with the essential requirements of the Technical Regulations is carried out using one of the following conformity assessment procedures:
- internal production control (module A);
- type examination combined with conformity to type based on internal production control (module B+C);
- conformity based on full quality assurance (module H).
To confirm compliance with the requirements of the Technical Regulations, it is necessary to provide complete information about the radio equipment. The technical documentation must contain the following elements:
1) a general description of the radio equipment, in particular:
- photographs or illustrations showing the external appearance, marking and internal layout;
- software versions or firmware versions that may affect compliance with the essential requirements;
- user information and operating instructions;
2) technical project, including technological drawings and diagrams of components, subassembly, electrical diagrams and other similar information;
3) description and necessary explanations for understanding such drawings and diagrams and operation of radio equipment;
4) a list of standards from the list of national standards that are identical to harmonized European standards and compliance with which gives presumption of conformity of radio equipment with the essential requirements, or, where such standards have not been applied, a description of the decisions taken to ensure compliance with the essential requirements of the Technical Regulations for Radio Equipment.
5) results of design calculations, inspections, test reports and other similar information;
6) if available: a copy of the declaration of conformity from the manufacturer, a copy of the type examination certificate and its annexes, which were issued by the designated body;
All information is prepared and submitted in accordance with the law on the procedure for the use of languages.
If, after examining the technical documentation and supporting documents regarding product quality, it is established that the radio equipment complies with the requirements of the Technical Regulations, the conformity assessment body issues a type examination certificate. After that, a Declaration of Conformity is drawn up and a mark of conformity to the Technical Regulations may be affixed.
