Technical Regulation No. 139 Restrictions on the use of certain hazardous substances in electrical and electronic equipment.

According to the resolution of the Cabinet of Ministers of Ukraine dated March 10, 2017 No. 139 (formerly TR 1057), from September 11, 2017, the Technical Regulation Restrictions on the use of certain hazardous substances in electrical and electronic equipment came into force and became mandatory.

Categories of electrical and electronic equipment subject to the Technical Regulations on the restriction of the use of certain hazardous substances in electrical and electronic equipment:

  1. Large household appliances.
  2. Small household appliances.
  3. Information technology and telecommunications equipment.
  4. Consumer electronics.
  5. Lighting equipment.
  6. Electrical and electronic tools.
  7. Toys, leisure and sports equipment.
  8. Medical devices (including in vitro diagnostic medical devices).
  9. Monitoring and control devices (including industrial monitoring and control devices).
  10. Automatic product dispensing and dosing devices.
  11. Other electrical and electronic equipment not falling under categories 1-10.

According to the requirements of the regulation, the manufacturer is obliged to provide a declaration of conformity with the requirements of the Technical Regulation before the electronic or electrical products listed therein are placed on the market.

In addition to the declaration of conformity, it is necessary to complete a Technical File, which includes the following data:

  • general description of the product;
  • preliminary design, production drawings and diagrams of components, assemblies, circuits, etc.;
  • descriptions and explanations necessary for the understanding of the specified drawings and diagrams and the operation of the product;
  • a list of fully or partially applied national standards and/or other relevant technical specifications, compliance with which gives a presumption of conformity of products with the essential requirements, and in the case where the specified standards have not been applied, descriptions of the decisions taken to ensure compliance with the essential requirements of the technical regulation. In the case of partial application of national standards, compliance with which gives a presumption of conformity of products with the essential requirements, the technical documentation shall indicate their parts that have been applied;
  • results of completed design calculations, conducted research, etc.;
  • test protocols.
