The Cabinet of Ministers of Ukraine adopted Resolution No. 1055 of 12/28/2016 "On approval of the Technical Regulations for equipment and protective systems intended for use in potentially explosive environments", which entered into force on 07/27/2017 and repealed Technical Regulations No. 898. The new regulations were developed on the basis of the European Union Directive 2014/34/EU (ATEX) of 02/26/2014.

According to the Technical Regulations and the EU Directive, mixtures of gases, vapors, mist or dust with atmospheric air that are capable of burning as a result of ignition are considered explosive environments.

Thus, the operation of equipment and various devices used in explosive environments poses an increased risk to humans, property and the environment, and therefore, such equipment is subject to mandatory control for compliance with safety requirements in the form of explosion-proof certification for compliance with TR 1055 in Ukraine (ATEX Directive - in the European Union).

At the same time, depending on the category of equipment and its scope of application, the following documents may be required for import and circulation:

  • type examination certificate (issued by the designated conformity assessment body);
  • declaration of conformity (issued by the manufacturer or authorized representative);
  • keeping the technical file with the designated conformity assessment body;
  • conclusion on the safety of using the product in explosive environments.

The manufacturer shall affix the mark of conformity to the technical regulations to each unit of product (except components) that meets the requirements of the Technical Regulations.

The manufacturer shall accompany each unit of product with a declaration of conformity and shall keep it together with the technical documentation for submission to the requests of the state market surveillance authorities for 10 years after the last product of this model has been put into circulation. The declaration of conformity shall identify the product model for which it was drawn up.

To calculate the cost of TR 1055 (ATEX) certification and work, it is necessary to provide:

  • Technical description of the product with a description of the explosion-proof design;
  • A set of design documentation (drawings, diagrams, specifications, etc.);
  • List of standards used, technical specifications;
  • Operating manual and passport;
  • Certificates for the product (its components) issued by a notified body for certification (for imported equipment) in the scope of the technical regulations for equipment and protective systems for explosive atmospheres (for example, Directive 2014/34/EU (ATEX) in the European Union)
  • Test reports according to the above-mentioned certificates.
